The bill proposes a requirement to have an individual or group health care service plan contract or health insurance policy issued, amended, or renewed on or after January 1, 2025, to incorporate comprehensive coverage for the treatment of obesity in the same way as other illnesses, conditions, or disorders.

This is to determine deductibles, lifetime dollar limits, copayment, and coinsurance factors, and benefit year maximums for deductibles and copayment and coinsurance factors. The bill proposes that a deliberate violation of these provisions by a health care service plan will be a crime, and it will impose a state-mandated local program.

It will be vital to enact the Obesity Treatment Parity Act to lower the prevalence of obesity rates in CA and mitigate the health effects of obesity in the population. The America’s Health Rankings (2024) ranks California fifth in obesity rates, with 28.1% of adults having obesity with a BMI of 30.0 or higher. Obesity is a complex health condition with biological, environmental, economic, individual, and societal causes.

Obese adults are more prone to have reduced quality of life and increased risk of developing adverse health conditions (Kranjac & Kranjac, 2023). Therefore, it will be vital to enact a bill that mandates insurance policies to cover the treatment of obesity.
